Painting by Numbers Shop® (“we,” “us,” or “our”) operates the website https://paintingbynumbersshop.com (the “Site”). These Terms of Service (“Terms”) govern your access to and use of the Site and your purchase of products from us.

By accessing the Site, creating an account, uploading content, or placing an order, you agree to these Terms and to the policies incorporated by reference below. If you do not agree, please do not use the Site or place an order.

1. Eligibility and Use of the Site

You must be at least the age of majority in your place of residence to make a purchase. A minor may use the Site only with the involvement and permission of a parent or legal guardian.

You may use the Site only for lawful personal or business purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Site and our products complies with laws applicable to you.

2. Accounts and Customer Information

If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account. Please notify us promptly if you believe your account has been used without authorization.

You agree to provide current, complete, and accurate contact, billing, shipping, and order information. We are not responsible for delays or failed delivery caused by incorrect information supplied by the customer. Address changes are governed by our Shipping Policy.

3. Products and Product Information

We make reasonable efforts to describe and display our products accurately. However, screen settings, lighting, source-image quality, product size, canvas texture, paint colors, printing, and production processes can cause reasonable differences in color, crop, detail, or appearance.

Product photographs and digital previews are illustrative. Minor differences that do not materially affect the product’s intended use are not necessarily defects. This provision does not affect your rights if a product is faulty, damaged, materially different from its description, or not as ordered.

Our paint by numbers kits are prepared for each order and are not maintained as traditional stock inventory. Tools and accessories are subject to availability. We may modify or discontinue products, options, or accessories at any time, but a change will not affect an order already accepted unless we contact you and offer an appropriate solution.

4. Orders and Contract Formation

Placing an order is an offer to purchase the products in your cart under these Terms. An automated order acknowledgment confirms that we received your order but does not necessarily mean that the order has been accepted.

A binding sales contract is formed when we confirm acceptance of the order or dispatch the order, whichever occurs first, unless applicable law provides otherwise.

We may reject or cancel all or part of an order before dispatch for legitimate reasons, including suspected fraud, unauthorized payment, a material pricing or description error, an inability to produce or deliver the product, violation of these Terms, or a legal or shipping restriction. If a tool or accessory becomes unavailable, we will contact you and provide the options described in our Shipping Policy.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method for the cancelled products. We will not substitute store credit unless you expressly agree or applicable law permits it.

5. Prices, Payment, Taxes, and Duties

Prices are displayed in U.S. dollars (USD) unless another currency is clearly shown. Prices and product offers may change without notice, but changes will not affect an order that we have already accepted.

You authorize us and our payment providers to charge the payment method selected at checkout for the order total. Payment processing is provided by Shopify and the payment provider selected by you. We do not generally receive or store complete payment card details.

Applicable shipping charges are displayed at checkout. Sales tax, import duties, and related charges are handled as described in our Shipping Policy. If a checkout, tax, or pricing error occurs, we may contact you to confirm the correct amount or cancel and refund the affected order.

6. Promotions, Discounts, and Gift Cards

Promotions, discount codes, free gifts, and multi-buy offers are subject to the conditions displayed with the offer, including eligibility, dates, product exclusions, minimum quantities, and whether offers can be combined. Unless stated otherwise, only one discount or promotion may be applied to an order.

We may correct or cancel a promotion affected by an obvious error, misuse, manipulation, or unauthorized distribution. This does not allow us to withdraw a promotion from an order after acceptance where doing so would violate applicable law.

If part of a discounted bundle, “buy one, get one,” or similar promotional order is returned, the refund will be based on the amount actually allocated and paid for the returned item. If returning an item causes the remaining order to no longer meet the promotion’s conditions, the refund may be adjusted to reflect the promotion, to the extent permitted by law.

Gift cards may be used only as stated on the Site. They are not redeemable for cash and are non-refundable except where required by law. Expiration and other restrictions, if any, will be applied only as permitted by applicable law.

7. Custom-Made Products and Uploaded Images

Custom paint by numbers kits are created from a photograph or other specifications submitted by the customer. You retain ownership of the image you upload.

By uploading an image, you confirm that:

• you own the image or have all permissions necessary for us to use it to fulfill your order;
• our use of the image for your order will not infringe copyright, trademark, privacy, publicity, or other rights;
• the image does not contain unlawful, abusive, hateful, sexually exploitative, or otherwise prohibited material; and
• you have appropriate permission from identifiable individuals shown in the image, where permission is required.

You grant us a limited, non-exclusive license to host, copy, crop, resize, adapt, reproduce, and share the uploaded image with our secure upload, production, and fulfillment providers solely as reasonably necessary to prepare, manufacture, deliver, and support your custom order. We do not acquire ownership of your image and will not use it for unrelated public advertising without permission.

We may decline an uploaded image if we reasonably believe it violates these Terms, applicable law, or the rights or safety of another person. If we cannot produce the order using the submitted image, we will contact you to request a replacement image or offer an appropriate refund.

8. Shipping and Delivery

Processing times, estimated transit times, shipping rates, delivery restrictions, tracking, taxes, duties, P.O. boxes, military addresses, damaged parcels, and lost shipments are governed by our Shipping Policy.

Delivery dates and transit times are estimates rather than guarantees unless we expressly agree to a guaranteed date. If a delay requires your consent or gives you a right to cancel under applicable law, we will provide the required notice and options.

Risk of loss or damage remains with us until the product is delivered to you or a person designated by you, except where you independently appoint a carrier not offered by us and applicable law provides otherwise.

9. Cancellations, Returns, Refunds, and Warranty Claims

You may request cancellation before an order is dispatched. Once an order has been dispatched, the return rules will apply.

Eligible unused, non-custom products may be returned when the return request is submitted within 30 days of delivery. Customers are responsible for arranging and paying for change-of-mind return shipping. Approved refunds are issued to the original payment method rather than as store credit or credit toward a future purchase.

Custom-made products are excluded from change-of-mind returns as explained in Section 7. Valid claims under our 90-day commercial warranty may qualify for a refund or replacement, subject to the conditions in our policies and applicable law.

Complete instructions and conditions are contained in our Return & Refund Policy. If there is a conflict concerning a return or refund, the Return & Refund Policy will apply, subject always to mandatory consumer law.

10. Intellectual Property

The Site and its content, including text, graphics, logos, icons, photographs, product presentations, videos, software, layout, and compilation, are owned by or licensed to Painting by Numbers Shop® and are protected by applicable intellectual property laws.

We grant you a limited, revocable, non-exclusive, and non-transferable right to access and use the Site for lawful personal shopping and informational purposes. You may not copy, reproduce, distribute, sell, license, modify, publish, scrape, or commercially exploit Site content without prior written permission, except where permitted by law.

These Terms do not transfer ownership of our intellectual property or of third-party intellectual property displayed on the Site.

11. Reviews, Feedback, and Other User Content

If you submit a review, photograph, video, comment, or other content for publication, you retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, format, translate, display, distribute, and use that content in connection with operating and promoting Painting by Numbers Shop® and its products.

This license lasts for as long as the content is used for those purposes, subject to your privacy and other non-waivable rights. You may contact us to request removal of published personal content. Removal from active display may not delete copies that must be retained for legal, security, backup, or recordkeeping purposes.

You confirm that submitted content is accurate, is based on a genuine experience where represented as a review, and does not violate another person’s rights. Content must not contain unlawful, defamatory, deceptive, abusive, obscene, infringing, malicious, or confidential material.

We may moderate or remove content that violates these Terms or applicable law. If an incentive is offered for submitting a review, the incentive is not conditional on the review being positive.

12. Prohibited Uses

You must not:

• use the Site or products for an unlawful, fraudulent, or unauthorized purpose;
• infringe intellectual property, privacy, publicity, or other rights;
• submit false, misleading, impersonating, or fraudulent information;
• upload malware, viruses, harmful code, or content designed to disrupt the Site;
• attempt to bypass security, authentication, rate limits, checkout rules, promotion conditions, or access controls;
• scrape, crawl, harvest, or collect Site data or personal information without authorization, except as permitted by law;
• interfere with the Site, its servers, networks, or another user’s access;
• use automated systems to place fraudulent orders, manipulate reviews, or abuse promotions; or
• use the Site to harass, threaten, exploit, or harm another person.

We may restrict or terminate access, reject content, or cancel an unaccepted order if we reasonably believe these rules have been violated.

13. Third-Party Services and Links

The Site is hosted by Shopify and may contain services, applications, payment options, or links provided by third parties. Third-party services may be subject to their own terms and privacy policies.

We are not responsible for the independent content, security, availability, or practices of a third-party website or service that we do not control. This does not exclude responsibility that applicable law places on us for service providers acting on our behalf.

14. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the Site, you acknowledge that personal information will be processed as described in that policy and according to the privacy choices available to you.

15. Informational Content

Blog posts, guides, product tips, and other informational content are provided for general educational purposes. They are not medical, legal, financial, or other professional advice. References to relaxation, focus, wellbeing, or similar experiences describe general hobby-related information and do not promise a medical or therapeutic result.

16. Availability and Disclaimer of Warranties

We make reasonable efforts to keep the Site available, accurate, and secure, but we do not guarantee that access will always be uninterrupted or error-free. We may temporarily restrict access for maintenance, security, technical, or operational reasons.

To the maximum extent permitted by law, the Site is provided on an “as available” basis. Products are subject to the express warranties and policies stated on the Site and to all statutory warranties, guarantees, and consumer rights that cannot be excluded.

Nothing in these Terms excludes warranties, guarantees, or remedies that must apply under consumer law.

17. Limitation of Liability

To the maximum extent permitted by law, Painting by Numbers Shop® and its service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the Site or purchase of a product when that type of loss was not reasonably foreseeable.

Where a monetary limitation is legally permitted, our aggregate liability for a claim relating to a product will not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or breach of mandatory consumer rights.

18. Responsibility for Your Conduct

To the extent permitted by law, you are responsible for losses, claims, or reasonable costs arising directly from your unlawful use of the Site, your material breach of these Terms, or content you submit that infringes another person’s rights. This section does not require a consumer to compensate us for losses caused by our own conduct or for matters beyond the consumer’s reasonable control.

19. Events Beyond Reasonable Control

We are not responsible for delay or failure caused by events beyond our reasonable control, such as natural disasters, severe weather, war, civil disturbance, epidemic, government action, labor disruption, transportation interruption, carrier failure, utility outage, cyberattack, or failure of essential suppliers.

We will take reasonable steps to reduce the effects of the event and will communicate material delays where reasonably possible. This section does not remove any right to cancel or receive a refund that applies under law or our published policies.

20. Governing Law and Disputes

These Terms and transactions with Painting by Numbers Shop® are governed by the laws of the State of Wyoming and applicable federal laws of the United States, without regard to conflict-of-law principles.

If you are a consumer, this choice of law does not deprive you of mandatory protections provided by the laws of your country or state of residence. You may bring a claim in any court that has jurisdiction under applicable consumer law.

Before starting formal proceedings, we encourage you to contact us at support@paintingbynumbersshop.com so that we can attempt to resolve the issue. This does not prevent either party from seeking urgent relief, using a small-claims process, contacting a regulator, or exercising another legal right.

21. Changes to These Terms

We may update these Terms to reflect changes to our services, business practices, or legal obligations. Updated Terms will be posted on this page with a revised “Last updated” date.

Changes apply prospectively from the stated effective date. An order already accepted remains subject to the version of the Terms and policies that applied when the order was accepted, unless a change is required by law or you expressly agree otherwise.

22. General Provisions

If any provision of these Terms is found unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of that provision. We may assign these Terms as part of a merger, reorganization, financing, or transfer of the business, subject to applicable law. You may not assign contractual rights or obligations without our consent, except where applicable law permits otherwise.

These Terms, together with the policies and order information incorporated by reference, form the agreement between you and us concerning the Site and your purchase. If a product page, checkout disclosure, or written agreement provides a more specific term for a particular product or transaction, that specific term will apply to that matter.
